Wedding Terms and Conditions
These are my contract terms and conditions as they are printed in my contract.
BOOKING FEE – A booking fee of UKŁ200 is charged when The Client signs the contract. The Booking Fee is not returnable and is deducted (in full) from the Total Price on completion of the contract.
DISPLAY – The Photographers shall be permitted to use any photograph included in this contract as promotional material without payment of any fee. (This will include publication on the internet.)
PHOTOGRAPHS – The Photographers will seek to provide a pleasing colour balance but cannot guarantee exact colour matching. Owing to anomalous reflectance caused by a combination of certain dyes and materials it is often impossible to record on film the exact colours seen by the human eye. Digital retouching, enhancement, and finishing are available at extra cost.
RE-ORDERS - All re-orders shall be treated as an extension of this contract. No responsibility for error will be accepted unless orders are given in writing.
COPYRIGHTS - The 1988 Copyright Act assigns the copyright to The Photographers. It is contrary to the Act to copy, or allow to be copied, any photographs covered by this contract. Previews and Proofs remain the property of the Photographer unless otherwise specifically contracted in writing. Negatives and/or Digital Files are kept on active file for six months after which a search fee supplement will be charged in addition to the prices in effect at the time. Negatives and/or Digital Files remain the property of The Photographers and shall normally be kept by him for not less than 3 years from the wedding date.
LICENCE - The Photographers shall be granted artistic licence in relation to the poses photographed and the locations used. The Photographers’ judgement regarding locations, poses and number of photographs taken shall be deemed correct. No single picture can be guaranteed although the Photographer will always try to give the Client everything wanted.
PRICES – All prices are ex-studio. This contract normally fixes the price of the minimum order but, where the booking is 9 months or more in advance, The Photographers reserve the right to increase prices to cover increased costs, etc. The price of your minimum order will never be increased by more than 7˝% unless the booking is made 18 or more months in advance when any increase will be limited to 15%.
SELECTION ALBUM - In the event that the Selection Album is lost or damaged before it is returned to The Photographer, or its non return within 4-6 months, The Photographers may invoice the full value, at current prices, of the album and all missing or damaged photographs. Proof of posting does not constitute proof of return and delivery under signature, if posted, is recommended
FORCE MAJEURE or ACT OF GOD – The due performance of this contract is subject to alteration or cancellation by The Photographers. In the unlikely event of total photographic failure or cancellation of this contract, The Photographers’ liability shall be restricted to the refund of all monies paid.
CANCELLATION – Only cancellations in writing can be accepted. In the event that The Client cancels the contract by giving written notice the booking fee shall be forfeited. In addition, if notice of cancellation be received by The Photographers 6 calendar months or less prior to the appointment The Clients shall pay The Photographers a sum equal to 60% of the minimum order specified in the schedule. The said sum shall be payable as compensation, it being an agreed estimate of the loss The Photographers would suffer. Separate insurance is highly recommended.
COMPLAINTS – Any complaints should first be raised with The Photographers in writing within 21 days from receipt of the photographs. In the very unlikely event of an unresolved complaint then The Client may request the Master Photographers Association to conciliate, whose decision shall be final and binding upon both parties.
